Participants will learn how to plan a response to an investigation addressing discrimination and harassment issues, including the planning of the investigation, the investigation, as well as a company’s response to a finding substantiating the investigation. The session will also address unique issues attorney investigators face in investigations that include warnings to witnesses, third-party attendees, and two key privileges: attorney-client privilege and the attorney work product doctrine. Finally, additional faculty members will join Kathryn and Thurston for a discussion on common but difficult occurrences in investigations involving race, gender and more. The issue will be covered from all sides; the investigator, in-house attorneys, employee and employment counsels. All will share practical advice on what to do when the issue has many gray areas.
