Marital/Non-Marital Characterization and Forensic Tracing

Explore the legal and forensic issues at play in tracing investment accounts and businesses established prior to the marriage. Discuss alternatives in situations where account statements are no longer available such that a conventional tracing of a given premarital investment account is not possible. In connection with the analysis of premarital businesses, the ramifications of loans, capital contributions and changes in the given business’s circumstances, such as a restructuring and/or change of ownership via a shareholder buyout, will be analyzed. Other topics that will be addressed are issues surrounding retained earnings and the reasonableness of the compensation of the shareholder spouse.
