This course provides a broad overview of Illinois land trust law and administration. It covers the various, well-established uses for the land trust (privacy, estate planning, liability protection), as well as new and emerging uses (title fraud protection). It also discusses the legal instruments involved in establishing and administering a land trust, focusing on attorney drafting considerations. In addition, it covers the legal relationships between the parties to the trust, including the trustee, primary beneficiaries, contingent beneficiaries, as well as collateral assignees. It includes discussions of both legislative and case law updates.
