How much process is due when conducting an administrative hearing process? What is the secret to administering adjudicatory hearings the courts will love? This session will focus on due process concerns when setting up and administering a decision making or appeal process. Issues such as when are hearings necessary and how formal they must be, will be covered, as well as preparing an administrative record. The essential elements of a hearing process, including the impartiality of decision makers and the applicability of the rules of evidence, will be discussed. Finally, considerations in preparing a written decision that will withstand judicial review will be covered.
