The Illinois Supreme Court issued a landmark decision in McAllister v. Illinois Workers’ Compensation Commission on September 24, 2020. The Supreme Court clarified the ‘arising out of’ standard in determining whether a petitioner sustained a compensable accident. The court discussed the Young and Adcock cases and resolved the split among appellate court districts.
