Initiating the Guardianship Process under the Probate Act & Considerations for Services under the Mental Health Code
1.0 Professional Responsibility Hour

This first part of this session will address considerations for initiating guardianship proceedings. This topic will highlight: petitioning and physician's report; who is qualified to act as guardian under the Probate Act; the legal effect of the appointment of a guardian, duties and responsibilities of guardians; and other practical aspects of the court process. The first topic will close will close with limitations on guardians regarding mental health services. The second topic will address services under the Illinois Mental Health and Developmental Disabilities Code. This topic will highlight: definition of mental illness; what is excluded from the definition of mental illness; what are the admission and discharge processes for psychiatric facilities; and what are the rights to treatment and right to refuse treatment including psychotropic medication. The questions will be explored by examining statutes and relevant case law.
