Does a low emotional intelligence quotient (EQ) put lawyers at higher risk for malpractice liability and ethical violations?  Lawyers test at low emotional intelligence compared to the general population and other professions. They are particularly low in a critical component of emotional intelligence: emotional perception, or awareness of their own and others’ emotions.  So what is emotional intelligence and how does it relate to the ethical practice of law?  Are there concrete and practical ways lawyers can enhance their EQ?

Whistleblowing is making the news on an almost daily basis. When lawyers feel the need to "blow the whistle", what are the ethical concerns? We'll explore the following issues: When corporate counsel or a government lawyer discovers illegal or fraudulent counsel, what should they do? How can lawyers abide by their ethical duties of loyalty and confidentiality and to report wrongdoings? Can lawyers receive SEC or FCA bounties or awards? Is there any recourse if the lawyer faces retaliation?
